ANALISIS DAMPAK REGULASI (RIA) - Proses desentralisasi di Indonesia telah mengalihkan sebagian besar kewenangan pemerintah nasional ke lebih dari 460 pemerintah kabupaten/kota. Transisi dramatis ini, meskipun positif dari sudut pandang demokrasi, telah diwarnai dengan persoalan-persoalan administratif dan insentif kebijakan yang tidak pada tempatnya. Proses pembuatan regulasi di daerah ditandai dengan lemahnya analisis, belum adanya mekanisme review yang efektif, dan terbatasnya partisipasi publik. Akibatnya, muncul peraturan-peraturan daerah bermasalah, khususnya yang membebani dunia usaha.

Indonesia's mass-based Muslim organizations are increasingly at the forefront of new policy reform efforts to reduce poverty and improve governance at the city, district and provincial levels. The Asia Foundation has supported these efforts in a concerted fashion through partnerships with Muhammadiyah, Nahdlatul Ulama, and highly skilled technical advocacy and governance reform NGOs. This program builds on existing networks of Indonesian mass-based Muslim organizations by bringing the influence and credibility of Islamic organizations together with the technical advocacy experience of economic reform groups.

Building on 35 years of collaboration with Muslim organizations in Indonesia, The Asia Foundation currently supports Islamic civil society organizations in their efforts to strengthen democratic institutions, improve local governance, and reduce poverty in Indonesia. These organizations have long formed the vital core of Indonesia's civil society and continue to play a leading role in democratic reform and improving social conditions. They include groups belonging to the mass-based organizations Nahdlatul Ulama (NU) and Muhammadiyah which together claim over 60 million members, with networks that span the country from the national down to the district and village levels. Commanding legitimacy and influence in both state and society in Indonesia, Islamic organizations are a natural partner in Indonesia's development.

The Asia Foundation’s conflict management and prevention program aims to reduce the effects of violence on development and to help prevent future violent conflict. Events of 2006 show that outbreaks of violence can destabilize economic and democratic development and slow progress. In response to these events, The Asia Foundation is addressing the crisis by linking critical governance vulnerabilities directly to the underlying causes and enabling factors of the violence. The Foundation is facilitating consultations with Timorese leaders to formulate practical recommendations for governance reform for policymakers that will help reduce the potential for violent conflict in the near- to mid-term.

Organisasi massa Islam di Indonesia saat ini sedang mengembangkan upaya ke depan dalam memperbarui reformasi kebijakan untuk penanggulangan kemiskinan dan peingkatan tata pemerintahan di tingkat kota/kabupaten dan propinsi. Asia Foundation mendukung upaya tersebut dalam bentuk yang nyata melalui kemitraan antara organisasi massa Islam seperti Muhammadiyah, Nahdlatul Ulama (NU) dan LSM yang memiliki ketrampilan teknis dalam advokasi dan reformasi tata pemerin- tahan. The Asia Foundation supported the establishment and construction of the first women’s shelter in the Lao PDR—opening in January 2006—to serve the needs of victims of human trafficking and domestic violence. The establishment of the shelter, a direct result of growing awareness of these problems in Laos and the passage of the 2004 Development and Protection of Women Act, was made possible by the dedicated work of the Lao Women’s Union (LWU), which has been supported by the Foundation for more than a decade.

The Asia Foundation supports economic reform programs to encourage sustainable market-led growth, poverty reduction, and private sector involvement in the policy reform process. Better policies will boost business growth and employment, and help improve competitiveness and reduce poverty. In Cambodia, micro, small and medium enterprises (MSMEs) dominate the economic landscape, particularly in the provinces. MSMEs owners are among those most affected by a poor business environment, consisting of opaque regulations, lack of information, and extensive costs associated with corruption and over-regulation. The Asia Foundation’s economic reform program in Cambodia supports reform of policy-making process, empowerment of the private sector— particularly provincial MSMEs and development of a more business-friendly environment. The program encourages increased transparency and greater competition to create appropriate incentives for investment and trade.
